Employing A Carer

Here is a brief summary of what employing a Carer involves:

  1. It is possible to claim tax relief on the cost of employing a Carer in your own home if you employ one for yourself or for another family member who is totally incapacitated by old age or infirmity.
  2. The term “totally incapacitated” means being disabled to the extent that a Carer is required.
  3. Where two or more people employ the Carer, the allowance will be apportioned between them.
  4. The maximum allowance for 2010 is €50,000 and the relief is granted at the marginal (or higher) tax rate.
  5. You can employ the Carer directly yourself which means that you should register as an employer with the Revenue Commissioners. You will then be obliged to calculate and deduct PAYE, PRSI and the Income Levy on behalf of your employee and forward that payment along with a P.30 on a monthly or quarterly basis to the Collector General. You will also have end of year filing obligations.
  6. You must claim tax relief on the cost of employing a Carer each year.
  7. Please be aware that you cannot claim tax relief for a Carer if the Carer only carries out housekeeping duties or if a Dependant Relative Tax Credit or an Incapacitated Child Tax Credit has already been granted.
  8. If you are a PAYE taxpayer you can apply for tax relief for employing a Carer on a form HK1.
  9. If you are a self employed taxpayer the claim for tax relief for employing a Carer should also be sent on a form HK1 and attached to your annual tax return.
